Changes to Consumer General Terms & Conditions

With effect from the 1st July 2018 we are making changes to our Consumer General Terms and Conditions.

The changes we are making relate to the application of any increases or decreases in recurring/subscription charges, one-off charges and any out of bundle usage charges as a result of adjustments to the Isle of Man's Retail Price Index (RPI) Rate, or other costs we incur in the provision of our services or in response to changes in market conditions.

What are you changing and how will it affect me?

If you are a retail customer who takes out service with us on or after the 1st July 2018 we have amended section 39 of our Consumer General Terms and Conditions reference F9/GT/01a.  Section 39 reads:

Price Changes
39. Manx Telecom reserves the right to adjust pricing at any time (which could be an increase or decrease), subject to providing at least 30 days’ notice in advance. Price adjustments can apply to monthly subscription charges and/or out of bundle rates. Each year Monthly Subscription Charges will be reviewed and may be subject to an annual price adjustment which can either be determined by Manx Telecom based on changes in the market and/or provision of service cost, or adjusted in line with the RPI Rate, (which could be an increase or a decrease). Price adjustments in line with RPI Rate will be announced in the February preceding the RPI Change, and the adjusted amount will appear on your April bill. Price adjustments that are introduced as a consequence of changes in the market and/or provision of service costs shall be notified at least 30 days in advance.

If you are a retail customer who has taken out service with us prior to the 1st July 2018 we have amended section 39 of our Consumer General Terms and Conditions reference F9/GT/01.  Section 39 reads:

39. Manx Telecom reserves the right to adjust pricing at any time (which could be an increase or decrease), subject to providing at least 30 days’ notice in advance for instances where the price change would have a detrimental impact, as defined in clause 40 a) of this document. Price adjustments can apply to monthly subscription charges and/or out of bundle rates;

(a) (i) For customers on contracts that have expired, each year Monthly Subscription Charges will be reviewed and may be subject to an annual price adjustment which can either be determined by Manx Telecom based on changes in the market and/or provision of service cost, or adjusted in line with the RPI Rate, (which could be an increase or a decrease). Price adjustments in line with RPI Rate will be announced in the February preceding the RPI Change, and the adjusted amount will appear on your April bill. Price adjustments that are introduced as a consequence of changes in the market and/or provision of service costs shall be notified at least 30 days in advance

Example of RPI Rate adjusted price changes If monthly subscription charges are £21 a month when you sign up, then: (RPI rates illustrative only)

If RPI announced is 3.0%, you would see your monthly airtime subscription charge increase to £21.63 a month on your first April bill (i.e. £21 x 1.030 = £21.63); and

If the following year’s RPI was announced as 2.7%, you would see your monthly subscription charge increase to £22.21 a month (i.e. £21.63 x 1.027 = £22.21401).

(a) (ii) For customers who are within their contract term as at 1 July 2018, Manx Telecom will commit to maintain the Monthly Subscription Charge for the duration of the term of the contract. Once the contract term has expired, the conditions of clause 39 (a) (i) shall be applied

(b) Your Out-of-Bundle prices may also change and we reserve the right to increase Charges at any time by any amount. We'll post details of Charges on our Website and, for those Charges that we provide with a recurring subscription, we'll let you know at least 30 days before the Charges are due to go up.

(c) If you do not accept the new Charges you may be able to stop using the services or terminate your Agreement by giving us notice within 30 days of being informed of the new Charges and subject to the conditions of clauses 40 a) and b) of this document being met. If you don't give us notice within 30 days you accept the new Charges and the Agreement will continue with the new Charges. Full details of how and when to give notice and the circumstances under which you can terminate your Agreement are defined in section 40 of this document.
